IMPORTANT BACK-TO-SCHOOL ANNOUNCEMENT from “The PATCH”
The initiative runs from Monday, July 28, to Monday, Aug. 4, between 8 a.m. and 8 p.m. Donated items will be placed in backpacks and given to students.
Donors should drop off the school supplies at the nearest DeKalb County fire station, and locations can be found on the department’s website.
The campaign began as a partnership between the fire department, the DeKalb County Black Firefighters Association and the DeKalb County Professional Firefighters.
The fire department is requesting the following items:

We are very happy to see that halfway through SPLOST IV Cross Keys will finally be granted a new track (as was supposed to be done in SPLOST II) !!!

According to the vendor spend report:
ALEXANDER & ASSOCIATES $905,308.30
However, the list of invoices goes back to JUNE, 2013. Oddly … $209,664.91 was expensed back to last year’s budget. Hmmmm.
In fact, this 584 page document shows A LOT of vendors invoices expensed back to last year. They neglected to add up the columns in total though – anyone care to try? We are curious how much of Thurmond’s ‘found’ $20 million + has now been eaten up in old bills paid late…. ?!

So who was selected for the law firm?
RE: the monthly Human Resources report for DCSD.
Some interesting points. . . as the report states it is for August. But, if you look at all the
names and dates they are all for the month of May and June. There are none in July.
Guess it takes them a month or so to get their stuff together and on paper.
Still seems as if there would be some cheap software or spread sheet that would collect the data,
collate and separate and produce informative, accurate information.
Oh well, as of this report, there were 290 resignations.

There are some interesting descriptive words this time.
“Resig-Contract Not Accepted” and “Resig-Not Released”
And, noteworthy were a couple of things.. . .as Noel Maloof left DeKalb to be principal
of Decatur High School—as he lives in Decatur.
Clarance Callaway–a Frankie Callaway legacy was Assistant Principal and is Resig–Not Released.
Jeanette James- the Director of Public Safety–who had been there awhile retired.
She was one of the few Caucasians remaining in a high level position.
Tarasha Wilson, Principal of Cross Keys listed “Spouse Transferred” as her reason for leaving.
(Although we know she is just moving over to Archer High School in Atlanta.) She must have
put this reason to keep from paying the $750 get out of your contract fee. Although, just
crossing over into the other part of the city into an adjoining system usually was not a valid excuse.
And, finally, Stephen Wilkins, Chief Operating Officer resigned with Resig–Contract not Accepted.
Didn’t realize he was not happy, or something or someone was not happy over on Montreal Road.
Seems as if he just slipped out at the end of the month of June. Will have to check to see
if this job has been posted–as this is a biggy.
If you add these teachers to last month’s report (almost 500)–and when we find out how
many more “left” in the month of July—it will be a substantial number.

Do we have a way to report out of zone students? Ethics violations? Is the DCSS ‘hotline’ still up and running? Anyone use it? If so, let us know how your experience was.
I took the 8/4/2014 HR report and sorted the resignations by reason. First are the employees who left without signing a contract for the 2014/2015 school year:
Retirements: 31 [CONGRATULATIONS!]
Contract Not Accepted: 18
Next are the employees who (probably) signed a contract for the 2014/2015 year, but are now departing DCS under an acceptable reason:
Spouse Transfer: 3
Personal Reasons: 10
Moving: 16
Family Responsibilities: 14
Another Position in Georgia: 25
Another Position: 6
Other: 4
Finally are the employees who signed a contract for the 2014/2015 year, but are leaving for reasons that DCS does not view as acceptable:
Resign, No Reason Stated: 5
Resign, Not Released: 69
Finally, an interesting comparison: More than three times as many employees resigned without being released (69) as employees that retired (31).
Here’s the 8/4/2014 HR Report sorted by location (schools).
This is only three columns — just the school, the job title, and the reason for leaving.
This data shows several schools taking big hits. For example, Jolly Elementary lost five teachers and Stone Mill Elementary lost seven teachers and a para. Southwest Dekalb High lost three teachers, two of which were “not released” and the other was a “no stated reason”. MLK High lost seven teachers, 4 of which were “not released”, a 5th was “no stated reason” and a 6th declined to sign their contract.
Tellingly, other DCS schools are retaining most of their educators. Dunwoody Elementary only lost a single teacher and that teacher took another job elsewhere in Georgia. Dunwoody High only lost its Principal (to a better district) and a single teacher.
I intend to go back and add the data from the previous HR reports. I’m pretty confident that the monthly HR reports and the vacancies posted on PATS will show that DCS’s current crappy leadership is damaging DCS’s majority-black schools the most.

Several of my friends have stated that the district gave them a hard time when they transferred to other districts. While discipline was a major factor, the $$$ was the biggest issue. They can’t continue to pay pennies and expect teachers to stay. The damage has already been done to our students. Even if they hire another superintendent for the 2015-16 school year, it will be too late.
Closely examining the HR report will allow you to predict problems that will be “breaking news” in the next three or four weeks.
For example, Arabia Mountain High lost a Math teacher (Contract not Accepted) and three English teachers (1 moving, 2 not released). With that many English teachers leaving, I would expect Arabia to have overcrowded English classes and/or students who are not able to enroll in their required English classes.

Chamblee Charter High had an unusually high number resign. I know of 2 math teachers, 3 English, the head counselor(retired) and 1 social studies. Almost all of them were coaches.
Does “resigned-not released” mean the teacher opted to pay the penalty to leave Dekalb?
And if so, does that mean teachers paid a total of $46,575 (69 x $675) to be released from the district?
Where does that money go? Could it pay for a full forensic audit?

The DeKalb County Fire Rescue Department will collect donated school supplies for DeKalb County elementary school students this week.
The initiative runs from Monday, July 28, to Monday, Aug. 4, between 8 a.m. and 8 p.m. Donated items will be placed in backpacks and given to students.
Donors should drop off the school supplies at the nearest DeKalb County fire station, and locations can be found on the department’s website.
The campaign began as a partnership between the fire department, the DeKalb County Black Firefighters Association and the DeKalb County Professional Firefighters.

Sort of. The ‘resigned-not-released’ teachers are the ones that HR claimed that they would fine $750. However, teachers I know claim that HR had no clue about how to actually assess that $750 fine. HR could not answer the most basic, straightforward written requests like “I am resigning, so per your memo and comments to the media, I owe you a $750 fine — to whom do I submit payment?”
I suspect the “$750 fine” was a bluff; I don’t think HR thought they would ever have to collect it from anyone.
They could never collect the $750 liquidated damages. In order to have a liquid damages clause, you must have a bonus clause. Otherwise, it won’t hold up in court. That is basic contract law.
For example, I can write a contract for a contractor saying he has 60 days to renovate my kitchen. If I write a penalty clause of saying he will owe $1000 a day for liquidated damages for every day late. I have to show either that I am offering a bonus clause for $1,000 per day for every day you are early. Or alternatively, I must be able to show that the penalty is actualy damages that are suffered.
So were did they get the $750 figure from? They pulled it out of the air most likely. What is the difference to hire 69 more people when you are hiring 500-600 a year?
dunnwoody Elementary lost a lot of teachers 8 and 3paras. Both AP’s transferred 1 having been at the school for a year to title one schools. Someone trying to make a point.

The Cross Keys track replacement is NOT part of SPLOST IV. It is being charged to Facilities Management. “The total budget for the track replacement at Cross Keys High School project will be charged to cost code 101.57.61.32.000101.752.0000” Interestingly, the BOE is being asked to approve $419K, but the line in the budget only has $329K allocated. The law firm selected is Nelson Mullins Riley & Scarborough LLP. Their website says they are based in Columbia, SC and have offices in Atlanta.
I predict the personnel matter will be approval of the replacement for COO Wilkins. Just guessing.

Read Ty Tagami’s latest article regarding the legal fees and money spent on lawyers over the past decade. It’s the thing that nearly broke the school system’s back. The original DSW blog hammered on the amount of money spent on lawyers and in fact, Cerebration was served a subpoena by King & Spalding for speaking out about the testimony given showing blatant fraud by Pat Pope and Crawford Lewis as well as the insane amount of money going to K&S for their involvement in the civil case. Kim Gokce and Cerebration wrote often about the hidden costs of legal fees and the fact that they were draining school resources. Retaining two law firms due to imagined ‘racial’ requirements was decried by all on the blogs. Nancy Jester got on the band wagon and demanded line item budgets showing what was being spent on legal fees as well as utilities. These citizens were mocked and bullied for their actions. Nancy was eventually replaced on the school board by the Governor – by a man whose wife has close connections to the Governor.
This new article at least vindicates those who complained about legal spending so many years ago, and were shut down.
DeKalb school officials admit overspending millions on lawyers
Over the decade that ended in 2012, the DeKalb County School District spent nearly $32 million more than it budgeted for legal fees, routinely overshooting — or underestimating — the planned expenditures for lawyers and forcing some of the harshest cutbacks in metro Atlanta when reckoning day arrived.
The spending led to an unprecedented, and illegal, deficit of about $15 million in 2012. That led to layoffs as a historic recession undermined tax revenue. High legal costs drew the attention of the Southern Association of Colleges and Schools, which placed the district on probation in 2012, alleging myriad governance problems, including legal fees that were diverting resources from the classroom.
This is the first comprehensive assessment of the legal costs and their effect on the district’s bottom line.
Most importantly, Ty adds this quote to his article,
Superintendent Michael Thurmond, who tasked Bell with uncovering what happened, called the spending a “breathtaking” failure in oversight.

So much for a search. At least we didn’t waste $30,000 on a pretend search firm!
No sane person who was actually qualified who apply for that Operations Chief position. The best you could get would be someone who had a 30 year pension which brought them the security of knowing they could walk away the next minute. They could be ethically above board and say, I am not going to do that. Then when threatened with their job if they don’t do the bidding of corrupt bosses they can walk away. Ussually, those corrupt want someone as corrupt as them, easily corrupt able, or dependent upon the job ( sole bread winner with lots of kids and financial obligations the C student, not the leader of the pact.).
The new county-mandated sign-in and sign-out procedures for teachers are onerous. The county has always treated (correctly) teachers as exempt employees under the Fair Labor Standards Act. This means there is no need to pay overtime. The county’s teacher handbook confirms this status.
Now, the county is threatening to dock teachers’ pay for failing to sign in or out, or for leaving school during the day. This is not permitted under the FLSA for exempt salaried employees. With all of the money spent on lawyers by DeKalb County, you would assume they would run things like this past their labor and employment counsel, but apparently they think they know the law best. Since FLSA plaintiffs’ lawyers can recoup their fees from the County, and since such a lawsuit would be a slam dunk win, this will be more money out of our schools and our pockets if they continue on this path.
